Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Waves Wellness+ web platform, including any related mobile applications and connected services (the "Service"), operated by Human Advantage Partners Inc. ("Waves Wellness+", "we", or "us"). By creating an account, signing in, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, you may not access or use the Service.

The Service is offered to authorized athletes and invited participants. Access is granted through organization invitations. You must provide accurate, current information when registering and keep your account credentials secure.

You are solely responsible for all activity that occurs under your account and for safeguarding your password and authentication tokens. Notify us promptly of any unauthorized use or security breach. We may suspend or terminate access if we believe your account has been compromised or used in violation of these Terms.

Waves Wellness+ is a performance intelligence platform that aggregates wearable signals, nutrition and hydration logs, Brain Thermometer assessments, and training data to generate personalized readiness scores, trends, and recommended actions.

The Service is provided for informational and performance-coaching purposes only. Insights and recommendations are not a substitute for professional medical evaluation, diagnosis, or treatment. Always seek the advice of a qualified health provider with any questions about a medical condition.

You are responsible for the data and content you submit to the Service, including nutrition logs, hydration entries, activity notes, and assessment responses. You represent that you have the rights to submit any content you provide and that it is accurate to the best of your knowledge.

Missing data is never treated as a negative result. You may decline to log any category of information; doing so may reduce the coverage and specificity of generated insights.

You retain ownership of your user content. You grant Waves Wellness+ a limited license to process your content solely as necessary to operate, improve, and secure the Service and to generate the insights described in these Terms.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Submit false, misleading, or inaccurate health or performance data.
• Attempt to access another user's data without authorization.
• Interfere with or disrupt the Service, its servers, or its integrations.
• Reverse engineer, decompile, or redistribute any part of the Service.
• Use the Service to diagnose, treat, or prescribe for any medical condition.

All software, design, scoring methodology, and branding provided by Waves Wellness+ remain the property of Human Advantage Partners Inc. or its licensors. No part of the Service may be copied, modified, or distributed without prior written permission, except as permitted by law.

The Service may integrate with third-party wearables, calendars, and data sources. These integrations are governed by their own terms and privacy practices. Waves Wellness+ is not responsible for the accuracy, availability, or privacy practices of third-party data sources, and you connect them at your own discretion.

Some features may require a subscription or payment. Where applicable, fees, billing cycles, and renewal terms will be disclosed before purchase. Paid features remain subject to these Terms. Unless required by law, fees are generally non-refundable.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that insights will be accurate, complete, or applicable to your individual circumstances.

To the maximum extent permitted by law, Waves Wellness+ and Human Advantage Partners Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including any decisions made based on generated insights.

You agree to indemnify and hold harmless Human Advantage Partners Inc. and its affiliates from any claims, damages, or expenses arising out of your content, your violation of these Terms, or your misuse of the Service.

You may stop using the Service at any time. We may suspend or terminate your access at any time for any reason, including inactivity or violation of these Terms. Upon termination, your right to use the Service ends; provisions that by their nature should survive (including ownership, disclaimers, and limitations of liability) will remain in effect.

We may update these Terms from time to time. We will indicate the "Last updated" date above. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes will be resolved in the courts located in that jurisdiction, unless otherwise required by applicable law.

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms constitute the entire agreement between you and Waves Wellness+ regarding the Service.
